- These terms and conditions and the information in this buy and fly! collector brochure govern the arrangements between you and Landround Marketing Ltd in relation to your participation in the buy and fly! programme. buy and fly! is operated by Landround Marketing Ltd, with the assistance of its subsidiary Landround Travel Limited, to whom all queries concerning redemption of paper and electronic points should be addresses at Dept AA 1364, PO BOX 4214, Dublin 2.
- buy and fly! collectors must be aged 18 years or over.
- Currently buy and fly! collectors must be resident in the Republic of Ireland or the United Kingdom.
- All flights/holidays booked using your buy and fly! points must commence in Ireland or the UK.
- buy and fly! points cannot be:
i: combined with any other discount, offer or promotion
ii: re-sold
iii: replaced if lost, misplaced or stolen
iv: converted from electronic points to paper points or
v: transferred to other collectors.
- Collecting points through a buy and fly! Credit Card – as a buy and fly! collector, you can earn points when using a buy and fly! Credit Card for card purchases. You will earn 1 point for every €10 spent.
You will not earn points on your buy and fly! Credit Card:
i: for gambling transactions, cash advances and balance transfers; or,
ii: if you breach the terms and conditions of your credit card account
a. In addition, points earned on card purchases will be deducted in the event of any refunds.
b. On each monthly Credit Card statement, you will be advised of the number of points you have earned during that statement period. These points will be issued to your buy and fly! account.
- All points values quoted in our publicity material are subject to possible fluctuation depending on seasonality and demand. The buy and fly! team have up-to-date point values - please check with them before booking your flight. Once your booking has been confirmed with Landround Travel Limited the points value will not change.
- All buy and fly! points have an expiry date – this is the date by which travel must be completed. The expiry date of electronic points can be found in the “my account” section of the buy and fly! website, once you have logged in, or by calling the buy and fly! team. The expiry date of paper points is printed on the reverse of the points.
- When making a flight reservation:
i: a minimum of seven days notice is required before your preferred date of travel
ii: you may cancel your booking at any time:
a. your buy and fly! points cannot be refunded; and
b. any taxes or other fees you have paid may not be refundable
iii: if you subsequently want to make an amendment this will be subject to a minimum €30 amendment fee, if the amendment can be made and we agree to it in writing
iv: all flights are subject to availability
v: any applicable taxes/passenger service charges are payable at the time of booking, by credit or debit card
vi: your flight is subject to the terms and conditions of the relevant airline (their terms and conditions are available on request)
vii for your own protection and peace of mind it is recommended that you and all other travellers in your party have adequate travel insurance and this insurance must either be purchased through buy and fly! at the time of making a booking for a flight or alternatively, you may provide us with written evidence of existing comparable cover.
- It is your responsibility to ensure that you have all the necessary documentation for your trip including passports, visas and any necessary health documents for the country you are visiting.
- For holidays and short breaks provided by third parties:
i: unless stated otherwise in this buy and fly! collectors’ brochure, you can redeem your electronic points and/or paper points for vouchers with which you can pay or part pay for your holiday or short break. To do so follow the instructions detailed in this collectors’ brochure
ii: terms and conditions are applicable to the use of each voucher. These are all listed at the back of the collector brochure and are printed on each voucher. Please note each voucher has a specific expiry date.
- Landround Marketing Ltd and Landround Travel Limited:
i: are not contracting with you to provide your flight and cannot be held responsible for the failure to perform of any airline or third party tour operator together with their partners, subcontractors and agents unless due to our negligence, or where we ourselves act as a tour operator to you
ii: reserve the right to withdraw or amend any offer, at any time, without notice. We will not make such changes to any confirmed bookings unless due to an unforeseeable event, beyond our control
iii: reserve the right to charge or claim from you the cash value of the published fare for any flight should the required number of points not be received.
- Landround Travel Limited holds appropriate memberships/bonds for circumstances where we act as a travel agent or tour operator. These are shown on the back cover of this brochure.
- To the maximum extent permissible in law, all conditions and warranties which are implied by statute or otherwise by general law into these terms and conditions in relation to goods or services are hereby excluded and without prejudice to the generality of the above the provisions Section 39 of Sale of Goods and Supply of Service Act, 1980 is hereby excluded and the parties agree that this is fair and reasonable.
- Notwithstanding the generality of the foregoing, neither Landround Marketing Ltd nor Landround Travel Limited will be liable to you for any representations (unless fraudulent) or for any special, incidental, indirect, punitive or consequential loss or damages, whether occasioned by the negligence, fault, error, omission, act or breach of Landround Marketing Ltd and/or Landround Travel Limited, their employees and partners, sub-contractors and agents and which shall include, without limitation, loss of business, revenue or profits, loss of use or data, loss of savings or anticipated savings, loss of investments, loss of goodwill, capital costs or loss of extra administrative cost whether or not foreseeable, arising out of or in connection with this agreement, whether in an action based on contract, equity or tort including negligence or other legal theory.
- The cash redemption value of a buy and fly! point is 0.01c.
- Details of how to redeem buy and fly! points are illustrated in this collector brochure.
- We collect and keep information about you for the following reasons:
i: identifying and communicating with you about your buy and fly! account (we are not able to open and administer your account without this, so please do not submit your details if you do not want us to contact you about your account by post or e-mail)
ii: tailoring our service to your requirement and preferences (including conducting market research surveys)
iii: providing you with information about our products and services
iv: providing your information to airlines or other third parties you wish to make a booking with, for the purpose of making that booking (where possible) and where appropriate to enable them to fulfil their contract with you
v: if you have indicated your consent, we may, provide you with information about the products and services of carefully selected third parties
vi: if you have indicated your consent, we may, provide your details to carefully selected third parties who may contact you by post, phone, e-mail, and mobile phone messages about their own products and services.
- These terms incorporate our privacy policy, which sets out additional details how we will use your information and collected data. Our privacy policy is available from www.buyandfly.ie/privacy.html or on request to PO Box 9037, Blackrock, Co Dublin. Please read our privacy policy and ensure you are in agreement with it before you register to become a buy and fly! collector.
- Please note that we reserve the right to vary participating airlines tour operators and travel operators from time to time. This will not affect any confirmed bookings.
- If we make changes to these terms and conditions we will give you as much notice as we reasonably can. Your continued collection of buy and fly! points will indicate your acceptance of such changes.
- These terms and conditions are governed by and interpreted and construed in accordance with Irish law and are subject to the exclusive jurisdiction of the Irish courts.
- If any provision of these terms and conditions is or becomes invalid, illegal or unenforceable in any respect then the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired.
- No waiver by either party for any failure by the other to observe or perform any provision of these terms and condition shall be deemed a waiver of any preceding, succeeding or continuing breach of such provision or of any other provision of these terms and condition.
- Words in the singular shall be construed as including words in the plural and vice versa; references to terms are references to terms of these terms and conditions and references to Landround Marketing Ltd and Landround Travel Limited include references to their successor in title and assigns.
- By providing us with the information required for any bookings, registration or any exchange forms, and ticking the appropriate box on the registration form or online, you are deemed to have accepted these terms (including our privacy policy) and to have gained consent from members of your party to disclose their details to us.
- If you do not tick this box we will not be able to process your registration or any booking.
